TERMS OF USE – Hyppobrain & Sophron

1. Who we are

Hyppobrain – strategic learning & capability services
Sophron – digital assessment platform currently in pilot phase

By using our websites or Sophron services, you agree to these Terms of Use.

2. Use of Sophron (Pilot Phase)

During the pilot period, your organisation receives a:

📌 Non-exclusive, non-transferable, limited licence
to use Sophron for internal compliance and learning purposes.

You may:

Conduct Sophron assessments internally
View and discuss results
Share reports within your own organisation
Reference Sophron in audit documentation (with attribution)

You may not:

Copy, reuse, or distribute Sophron content to third parties
Use Sophron to build your own assessment tool
Commercialise or resell any reports
Share account access with external parties

3. Intellectual Property (IP)

3.1. What is protected

The following Sophron elements are the property of Hyppobrain and are protected by copyright:

assessment questions and scenarios
scoring methodology (including SKA weighting)
the underlying competency framework
report and scoring layouts
the Sophron brand, logos, and visual identity
the methodology and expertise-based content behind Sophron

These may not be used without prior written permission:

copied in any form
used to build or enhance your own products
translated into a competing solution
shared with consultants, competitors, or software developers

3.2. What belongs to the customer

All data your organisation enters (responses, results, internal information) remains your property.

Hyppobrain processes this data solely in order to:

ensure proper functioning of the assessment
generate reports
produce anonymised statistics (optional)

We do not use your data for benchmarking or model training without explicit consent.

4. Confidentiality of Reports

Sophron reports contain sensitive internal information. Therefore:

You may:

distribute them internally on a need-to-know basis
use them for audits or management presentations
store them within your own secure systems

You may not:

publish them publicly
share them with consultants, software companies, or competitors
use them for commercial purposes
use them for HR decisions (hiring, termination, evaluations)

Each Sophron output includes the footer:
“Confidential – generated by Sophron for [Organisation Name]”

5. Restrictions (Realistic and Enforceable)

You agree to:

❌ not copy or reproduce any Sophron content
❌ not reverse-engineer Sophron (scraping, decompiling, reconstructing)
❌ not perform database extraction or scraping
❌ not offer any white-label version of Sophron
❌ not train AI models on Sophron questions or reports

In case of violation, Hyppobrain may:

suspend or terminate accounts
refuse delivery of future reports
end the collaboration
pursue legal action in the event of commercial damage

6. Liability

Sophron provides advisory insights, not legal certification.

Hyppobrain is not liable for:

decisions based on Sophron data
internal misinterpretations
damage resulting from improper use of reports
indirect or consequential damages

Maximum liability is limited to the fees paid in the 12 months prior to the incident.

7. Changes to these Terms

We may adjust these Terms as Sophron evolves into a full-featured platform. Users will be notified of any relevant updates.
